PHIL 155. Philosophy of LawIn this seminar, we will examine in-depth philosophical approaches to the theory and practice of law. We begin with the classical theoretical questions. We cover the foundations of law as explained through legal positivism, natural law, and critical legal theory. We examine the roles of lawmakers, citizens, and judges. We then move to questions with a more practical dimension. We discuss the foundation for criminal law and punishment as well as issues of racism and sexism in law. Other topics include individual rights, paternalism, policing, privacy, and technology This seminar is intended for Seniors and Juniors, with priority given to honors students taking it as an honors preparation.
